DEVELOPMENT OF THE INSTITUTION OF INTELLECTUAL PROPERTY IN THE CONDITIONS
OF DIGITALIZATION OF THE ECONOMY

Background. The article discusses the transformation of the institution of intellectual property in the face of challenges of the digital economy. In the digital reality, the mechanisms of creation, use and protection of intellectual property are of particular relevance. Intellectual property in the new conditions is positioned as a source of innovative development, a catalyst for economic development in general. The objectives of the study are the selection of problems of development of the institute of intellectual property in the conditions of digitalization and the proposal of ways to solve them.
Materials and methods. Realization of the research goal was achieved through a comparative analysis of individual factors of development of the intellectual property institute over a certain period, as well as key development indicators of the institution in question in various countries of the world based on statistical information. The methodological potential of the research includes the methods of systemic and comparative analysis, the historical method, methods of systematization and formalization, the statistical method.
Results. Based on the analysis of statistical, scientific and regulatory information, the contemporary challenges in the field of intellectual property in the digital economy are revealed. Identified trends in the development of state policy in the field of intellectual property. Based on the analysis of Rospatent data, the presence of the potential for transformation of work with the technologies of the corporate sector has been established. The improvement of the regulatory and institutional mechanisms for the creation and circulation of the results of intellectual activity in the digital economy is positioned as the planned results of the implementation of the complex of federal projects of the national project “Digital Economy of the Russian Federation”. The transformation of the institution of intellectual property is considered in the context of the main activities of the Government of the Russian Federation for the period up to 2024. The dominants of the development of the intellectual property institute in the conditions of digitalization are defined. The results of the study can be used to improve the mechanisms for creating and using intellectual property, as well as developing strategies for the development of intellectual property under conditions of digitalization at the level of an enterprise, industry, or state.
Conclusions. Conclusions about the transformation of the institution of intellectual property in the digital economy. Its focus should be to increase literacy of the population and business in the field of intellectual property; improvement of legal regulation in the field of creation, use and protection of intellectual property; stimulating the creation of the results of intellectual activity by the state and society; development and introduction of new digital technologies for managing intellectual property; adaptation of the rights of authors and other rights holders to the digital environment.
